At Tauniqo.ai we are committed to protecting and respecting your privacy. We want you to feel safe when we process your personal data. This Privacy Policy explains how we ensure your personal data is handled in line with applicable law. It applies to processing as controller and as processor, in relation to our customers, users of our services, visitors to our websites and other business contacts.

1. Use of Our Services

If you are a user of our services, you can use them in two ways:

• Consumer user (“Consumer User”): if you contracted services yourself, contacted us for information about our services, signed up for events or newsletters, or contacted us about a vacancy on our team.
• User of a customer company (“Subscriber Company User”): if you were invited to use our services by a company or other entity that is our customer (for example, the company you work for, or one where you take part in a hiring process).

Some forms of personal-data processing may vary depending on whether you are a Consumer User or a Subscriber Company User. That is why this Privacy Policy specifies when a type of processing applies only to a specific group.

If you are a Subscriber Company User, we process your personal data as processor or service provider when we offer our services to the company that contracted them (that is, the entity that invited you to use the platform, for example in a training or hiring process). In these cases, the customer company is the data controller.

In relation to this processing, Tauniqo.ai works with its customers to help them address any concern under the contractual terms in place and, for operational reasons, informs you about the processing of your data and guarantees the exercise of your rights as data subject.

Likewise, any de-identified data we collect on behalf of our customers or receive directly from a customer in our role as processor will be processed only in de-identified form, without attempting to re-identify personal information.

We commit to using your personal data only for the purposes specified in this Privacy Policy and never in a way incompatible with those purposes.

2. Data Controller

Tauniqo.ai is the controller of your personal data, except when we act as processor on behalf of a customer company.

3. Use of your Personal Data

3.1 Purposes of Processing

We use your personal data for the following purposes:

• If you are a Consumer User, to provide and manage our services, communicate with you, and add you to our database for newsletters or events.
• If you are a Subscriber Company User, to administer the agreement with the customer company.
• For administration and provision of support and account-management services.
• To improve our services by optimising our algorithms with user-feedback data.
• To carry out analysis, statistics and business development.
• To carry out marketing activities, including newsletters, social media, publications and events.
• To prevent fraud and other misuse.
• To comply with our legal obligations.
• To establish and defend legal claims.
• To enable mergers, restructurings or other transfers of Tauniqo.ai assets.

Tauniqo.ai does NOT use your data to train large language models.

4. User Rights

You have the following rights regarding your personal data:

• Access: you can request information about the personal data we hold about you.
• Rectification: you can ask us to correct inaccurate or incomplete data.
• Erasure: you can request deletion of your data when it is no longer needed for the purposes for which it was collected.
• Restriction of processing: you can ask us to limit the use of your data in certain circumstances.
• Objection: you can object to processing of your data when it is based on legitimate interests.
• Portability: you can ask us to provide your data in a structured format and to transfer it to another controller.

5. Collection of personal data

The personal data we process about you is data you have provided directly or that we have obtained in the course of providing our services.

We collect personal data in the following cases:

• If you are a Customer Company User, when we start a commercial relationship with a new customer company.
• When you create an account to use our services or when a new user is created within that account.
• When you interact with our services, submitting user-generated data.
• When you contact our support team.
• Through online forms and other means on our websites.
• When you apply for a job with us.
• When you look for general information about the company.
• Through emails sent or received by Tauniqo.ai.
• When you share information with us through meetings, conversations, social media or online forms.

6. Automated decision-making

We do not use automated decision-making processes.

7. Retention of Personal Data

We retain your personal data only for as long as necessary for the purposes for which it was originally collected, in accordance with this Privacy Policy.

When it is no longer necessary to store your data, we will anonymise it from our systems, databases and backups. The retention period depends on the context and, in some cases, cannot be specified exactly. In those cases we will provide information about the factors that determine the retention time.

In addition, we will continue to adequately protect personal data in our possession and require any authorised sub-processor to apply the same measures. As soon as the law allows, and at the customer company’s choice, Tauniqo.ai will securely anonymise or return all personal data.

8. Who we share your personal data with

We may share personal data with trusted third parties with whom we have agreements that ensure compliance with this Privacy Policy.

We may share data with:

• If you are a Customer Company User, with the respective customer company under the agreement for authorised users such as managers or trainers.
• External service providers, including for:
  • (i) Delivery of our services.
  • (ii) Supply of information, products and other requested services, including third-party services not operated by Tauniqo.ai.
  • (iii) Marketing and advertising.
  • (iv) Payment and transaction processing.
  • (v) Customer support.
  • (vi) IT services and technical support.
  • (vii) Fraud prevention and user authentication.
• Our subsidiaries and affiliated companies.
• A buyer or successor in the event of a merger, restructuring, dissolution or transfer of Tauniqo.ai assets.

In certain circumstances we may also need to disclose personal data at the request of government authorities, in legal proceedings or in the event of acquisitions, mergers or similar procedures.

Tauniqo.ai will not sell your personal data under any circumstances.

9. International transfers

Tauniqo.ai processes your personal data within the European Union (EU) and the European Economic Area (EEA).

However, it may occasionally be necessary to transfer personal data to countries outside the EU/EEA, either directly or through our sub-processors.

If we make such transfers, we will ensure there is a legal basis for them and that the level of data protection is equivalent to that established within the EU/EEA. We ensure this through:

• Transfers to countries with an adequate level of protection recognised by the European Commission.
• Implementation of standard contractual clauses approved by the European Commission.
• Obtaining your explicit consent when necessary.
• Justifying the transfer on the basis of the requirements set out in Article 49 of the GDPR.
